RESOLVED: That the designation of Dale Road, Llandudno, remains as a prohibited street for the purpose of street trading.
The Principal Trading Standards and Licensing Officer presented a report informing Members of an application by Hannah Ashton-Hughes, requesting consideration be given to change the designation of Dale Road, Llandudno from a prohibited street to consent for non-food retail. The applicant was invited to speak in support of the application to change the prohibited street designation, but declined the opportunity. For clarity, the Solicitor advised that the decision before the Committee was to determine if public consultation on the redesignation of the area should proceed, as opposed to a specific request for a proposed business. In considering the application, discussion arose regarding the following: · The prohibited street designation applying to Dale Road. Members were advised that it was within 50 metres of the street, potentially covering car parks or the promenade accessible to the public, subject to landowner consent · The criteria for street trading · The statutory process in terms of consultation · The consideration of representations · The potential impact on the residential nature of the area · The risks of potentially setting a precedent for allowing ‘other’ business to operate e.g. a licensed premises or takeaway · The proposed location and provision to designate a street trading space · Supporting local enterprises and tourism A proposal confirming the intention to change the designation of the requested areas from Prohibited streets to Consent streets (non-food retail) by means of appropriate statutory procedures and consultation was not seconded. RESOLVED: That the designation of Dale Road, Llandudno, remains as a prohibited street for the purpose of street trading.

Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
