RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act. Having regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the Statutory Guidance issued under by the DCMS and Home Office identified in the agenda item, and those to which it had been referred by the parties, it was: RESOLVED, having considered all the evidence placed before it, that the application should be granted subject to: 1. The withdrawal by the applicant of the request to show films 2. The licence conditions agreed between the applicant, the police and public health services. REASONS In coming to its decision, the Sub-Committee made the following findings: 1. The premises had previously been licenced from 2005 to 2023. 2. The premises has also been recently operating under a club premises certificate issued earlier in 2026. 3. TENS had recently been issued on 5 occasions in relation to the premises. No complaints or concerns have been notified to the Licensing Authority following their operation. 4. There had been no previous history of licensing enforcement action relating to the premises. 5. The applicant had previously been the DPS at another premises, the licence of which had been reviewed by the police on 2 separate occasions as a result of the applicant’s actions. 6. The 2nd review had resulted in the licence being revoked. 7. The applicant had agreed to the additional licence conditions proposed by the Police and Public Health Services. 8. None of the Responsible Authorities had objected to the granting of the application. 9. Laugharne Town Council had objected to the application. 10. The applicant wished to withdraw the request for a licence to show films in order to address the concerns raised by Laugharne Town Council. The Sub-Committee recognised that concerns and fears about what might happen, unless supported by real evidence, were not matters the Committee could consider. Similarly, the Sub-Committee recognised that the police and public health services are the primary source of advice respectively in relation to the crime prevention and public health objectives under the Licensing Act and that it must therefore attach weight to their views. Whilst the Sub-Committee acknowledged the concerns outlined by the Town Council in its representations, those concerns were not supported by real evidence and were not shared by the relevant responsible authorities.
RESOLVED On the basis that the applicant was convicted of a relevant offence on 4 December 2025, when he was disqualified from driving for a period of 12 months – sec 120(2) and Schedule 4 (as amended), the personal licence is refused.
