RESOLVED: That consideration of the application be deferred until the December Planning Committee.
Ms Lauren Eaton-Jones (joint applicant) spoke in support of the application, together with Councillor Cathy Augustine (Local Member for Penmaenmawr Ward). Further to a site inspection, an addendum to the report was presented, highlighting a correction to the Committee report - the total number of proposed affordable housing should read ‘20’. Discussion arose regarding housing demand in the area and the possibility of neighbouring land forming part of the site to enable a suitable waste turning area. In response, the Highways Officer advised that, the Highways Authority believed a solution could be reached, subject to further discussion with the applicant. Whist some Members were supportive of the application, the majority of Members supported a deferral to enable a satisfactory resolution in respect of waste collection proposals and highway safety. In response, the Principal Planning Officer advised that, in order to allow for sufficient time to determine the waste collection issues, an extension to the determination date to the December, 2024 Planning Committee would be advisable. RESOLVED: That consideration of the application be deferred until the December Planning Committee.

The application was deferred from the 14 August, 2024 Planning Committee (Minute 198(b) refers) to enable the submission of additional information. An addendum to the report was presented, indicating the submission of a Business Plan and Financial Plan (the latter had been submitted on a confidential basis), however, a summary of the Business Plan was provided within the addendum. Officers advised that the Business Plan and Financial Plan was insufficient justification for the proposed glamping pod for the following reasons: • The Business Plan stated that the glamping enterprise would form part of the applicant’s sole trader business. The information failed to explain how it would support the existing farm enterprise at Tyddyn Coed. • Limited information had been provided as to how the proposal would assist the existing business at Tyddyn Coed, other than to employ an additional worker and maintain flock and herd sizes. • The financial information did not relate to the existing business at Tyddyn Coed, it related to the applicant’s existing contracting business. In addition, the information related to turnover for the previous year and was unclear as to what it related to. Whilst some Members supported the officers’ recommendation to refuse planning permission, following a vote, and contrary to the officers’ recommendation, the majority of Members were supportive of the application and were minded to grant conditional planning permission on the following grounds: · The proposal would help the rural economy · The number of pods was limited to one · The proposal would contribute to the sustainability of rural communities in accordance with Technical Advice Note (TAN) 6 · The proposal was in accordance with the Wellbeing of Future Generations (Wales) Act 2015, as it contributed to objectives regarding resilience, cohesive communities and the Welsh language As the proposal was contrary to policy, Members were informed that the application would be referred back to the next Planning Committee meeting for further consideration. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission. (b) That, in accordance with approved procedure, the application be referred back to the next meeting of the Planning Committee for further consideration, as the resolution was contrary to officers’ recommendation. NOTE: Councillor Austin Roberts declared a personal interest in the above item. As the interest was not considered prejudicial, Councillor Roberts remained in the meeting whilst the matter was being discussed.

The application was deferred from the 11 September, 2024 Planning Committee (Minute 268(ii) refers) as the resolution was contrary to the Officer recommendation. An addendum to the report was presented, highlighting the following: · Whilst the Officers’ recommendation remained unchanged, Development Management Officers, in consultation with the Principal Environmental Health Officer, had drafted amended wording for conditions 9 and 10 in accordance with the Committee resolution of the 11 September, 2024 and expanded condition 9 to clarify monitoring requirements. In response, the applicant had stated that, whilst they had no concerns with the rewording of condition 9, they had requested further amendments to condition 10. Officers advised that, further amendments would need to be subject to a separate planning application in order to enable further consultation. • As the application was made under Section 73 of the Town and Country Planning Act 1990, it would be necessary to re-impose any conditions on the original permission that were intended to have continued effect. Should Members be minded to reaffirm their resolution of the 11 September 2024, Officers recommended that conditions 2, 3, 4, 5, 6, 7, 8, 13 and 14 be included in the new permission. It was also proposed to retain conditions 12 (landscaping) and 15 (earth banks and landscaping), but to reword them as the works referred to had already been undertaken, and to reword conditions 9 and 10 as above. In considering the above information, Members reaffirmed the resolution of the 11 September, 2024 to be minded to grant conditional planning permission, subject to the conditions referenced above. RESOLVED:- (a) That the Planning Committee be minded to grant conditional planning permission, subject to conditions highlighted above. (b) That the Development and Building Control Manager be authorised to determine the application under delegation. Note: Councillor Gwennol Ellis declared a personal interest in the above item. Councillor Nigel Smith (Local Member for Kinmel Bay Ward) spoke in support of the application and made reference to housing need and Technical Advice Note (TAN) 15. An addendum to the report was presented, indicating the submission of amended plans. Officers raised no objection to the amended plans and considered them to be an improvement on those previously submitted. Councillor Kay Redhead (Local Member for Kinmel Bay Ward) stated that there had been no known flooding on the site for many years, there was demand for housing, there had been no objection from local residents and the site was currently derelict and overgrown. Contrary to the officers’ recommendation, the majority of Members were supportive of the application and were minded to grant conditional planning permission on the following grounds: · There was a need for housing within the County · There had been no known flooding within the locality and Technical Advice Note (TAN15) was advice only As the proposal was contrary to the officers’ recommendation, Members were informed that the application would be referred back to the next Planning Committee meeting for further consideration. The Principal Planning Officer advised that, unlike previous applications considered by the Committee, this particular application had no means of refuge in an extreme flood event as the proposal was on the ground floor. In considering the application, a Local Member provided some background to the site, stated that there had been no known flooding within the locality for some time and that the need for housing in the area was high. In addition, it was noted that, flats both next door to the application site and opposite were also on the ground floor level. Contrary to the officers’ recommendation, the majority of Members were supportive of the application and were minded to grant conditional planning permission on the basis that the proposal would deliver housing in an area of housing need. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
Declarations are read from the minutes once they are published.
